This website is operated by Groovy Glassware. Throughout this contract the terms "us", "our", and "we" will refer to Groovy Glassware. The terms ''you'' and ''your'' will refer to the purchaser/user.

 

STORE TERMS

 

  1. GENERAL 
All products are intended for legal purposes only. By purchasing from our site you agree that you are aware of your local laws, that you are eligible to legally purchase the products, and will only use the products we sell for legal purposes only.

 

You may not use our products for any illegal purposes. No exceptions.

You personally take full responsibility for the product(s) you purchase. If importing and/or owning smoking accessories is illegal in your state, city, county, or country, Groovy Glassware accepts no responsibility as to verify the legitimacy of the order before accepting it. We will not reimburse you should any products be kept or destroyed by authorities.

Glass tobacco pipes have received a considerable amount of negative publicity over the years, due in part to the production of clear glass, bubble, or chemical pipes, which are arguably designed for one purpose and are clearly not designed for any tobacco or herbal blend. As a responsible retailer, it is important to recognize the differences between glass tobacco pipes and other limited use glass products. US Code 21-863 refers to ALL materials used to manufacture tobacco accessories; Wood, Meerschaum, Ceramic, Metal and yes, Glass. In specific, pipes with carburetion devices (third holes) are considered to be paraphernalia regardless of the material used to manufacture the pipe. Traditional tobacco accessories like pipes, cigar and cigarette holders and hookah/sisha pipes are not included in the list of Contemporary accessories. U.S. vs. Posters & Things (Supreme Court - 1996) upholds this code as the OBJECTIVE standard by which paraphernalia is judged. Further, it describes other relevant factors in this determination to include whether the owner is a licensed distributor or retailer of tobacco products! Ten states have adopted USC 21-863 as state law, three more are in the process of adoption. All other states have either less rigorous SUBJECTIVE (intent) statutes or no law on this subject at all!

All of our pipes conform to RTDA guidelines for bowl depth and width.

All names, logos, and trademarks are the property of Groovy Glassware and you may not use any of such materials for any purpose without the express written agreement of Groovy Glassware. 

 

     2. PRICE MODIFICATIONS & TERMINATION OF SERVICE

Groovy Glassware reserves the right to modify including but not limited to, any prices or information on the website at any given time without notice. Groovy Glassware also reserves the right to refuse the fulfillment of any sale if we are given reason to believe you going to use the product for illegal purposes or any reason felt necessary by Groovy Glassware without explanation. Groovy Glassware may terminate any account at anytime that is in violation of these terms.

 

 

      3. DISCLAIMER OF WARRANTIES & LIMITED LIABILITY

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall Groovy Glassware, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

To the fullest extent permissible pursuant to applicable law, Groovy Glassware disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement.
